User data collection and processing

The identity and contacts of Reactivitude, as a data controller and, if applicable, of its representative:

Procedures and measures applied to comply with the right to information
the information referred to in point C.1.1. is provided in writing (including electronic means) by Reactivitude to the User prior to the processing of the personal data in question. In accordance with the applicable law, Reactivitude, the company has no obligation to provide the User with the information mentioned in paragraph C.1.1. when and to the extent that the User is already aware of them.
This information is provided by Reactivitude at no cost.
Right of access
Reactivitude provides you with the means to access your Personal Data. The User has the right to obtain from Reactivitude a confirmation of which personal data concerning him are subject to processing and, if applicable, the right of access to his personal data and the following information:

- The categories of personal data concerned

Upon request, Reactivitude will provide the User with a free copy of the User Data being processed. The provision of other copies requested by the User may entail administrative costs.
Right to correction
The User has the right to request, at any time, the rectification of his Personal Data, as well as the right to have incomplete personal data completed, including through an additional statement.
In case of rectification, Reactivitude shall inform each recipient/entity to whom the data were transmitted of that rectification, unless such communication proves impossible or involves a disproportionate effort on behalf of Reactivitude.
Right to erase personal data ("right to be forgotten")
You have the right to request and obtain, from Reactivitude, the deletion of your data when one of the following reasons applies:
- User data are no longer required for the purpose for which they were collected or processed
- The User withdraws the consent on which the data processing is based and there is no other legal basis for such processing
- The User opposes the processing under the right of opposition and there are no prevailing legitimate interests justifying the processing
- If user data is processed illegally
- If User Data has to be deleted to comply with a legal obligation to which Reactivitude is subject
In the applicable legal terms, Reactivitude is not obliged to delete User Data to the extent that the processing proves necessary to comply with a legal obligation to which Reactivitude is subject or for the purpose of declaring, exercising or defending Reactivitude, company rights in legal proceedings.
If the data is deleted or deleted, Reactivitude shall inform each recipient/entity to whom the data were transmitted of the deletion, unless such communication is impossible or involves a disproportionate effort on behalf of Reactivitude.

- if the accuracy of the personal data is disputed, for a period allowing Reactivitude.
- If the processing is illegal and the User opposes the deletion of the data, requesting instead a restriction on its use
- If Reactivitude no longer requires User Data for processing purposes, but such data is required by the User for the purpose of declaring, exercising or defending its rights in legal proceedings
- In case the User opposes the treatment, until it is verified that Reactivitude, the legitimate reasons of the company prevail over those of the User
Where User Data is subject to restrictions, it may only be processed, with the exception of storage, with the consent of the User or for the purpose of declaring, exercising or defending a right in legal proceedings, defending the rights of another natural or legal person, or for reasons of public interest provided for by law.
Reactivitude should inform the User who has obtained a restriction on the processing of their data before this restriction is lifted.
In case of restriction of data processing, Reactivitude shall inform each recipient/entity to whom the data were transmitted of the restriction, unless such communication is impossible or involves a disproportionate effort on behalf of Reactivitude.
Right to data portability
The User has the right to receive the personal data concerning him or her, that he or she has provided Reactivitude, in a structured format, commonly used and machine-readable and has the right to transmit this data to another controller if:
- The processing is based on the consent or a contract to which the User is party
- Processing shall be carried out by automated means
The right of portability does not include inferred or derived data, i.e. personal data that is generated by Reactivitude because of, or resulting from, analysis of the data being processed.
Users have the right to have their personal data transmitted directly between data controllers where technically possible.
Right of object of processing
Users have the right at any time, for reasons related to their specific situation, to object to the processing of personal data concerning them in the exercise of legitimate interests pursued by Reactivitude or where the processing is carried out for purposes other than those for which personal data were collected, including profiling, or where personal data are processed for statistical purposes.
Reactivitude shall terminate the processing of User Data unless it can demonstrate urgent and legitimate reasons for such processing that prevail over the User’s interests, rights and freedoms, or for the purposes of declaring, exercising or defending Reactivitude, Company rights in lawsuits.
When user data is processed for direct sales (marketing) purposes, users have the right to object at any time to the processing of the data concerning them for the purposes of said marketing, which includes profiling insofar as it relates to direct marketing. If Users object to the processing of their data for direct marketing purposes, Reactivitudea shall cease processing the data for this purpose.
Users shall also have the right not to be subject to any decision taken solely on the basis of automated processing, including profiling, which has an effect in the legal sphere or has a similar significant effect, unless the decision:
- It is necessary for the execution or performance of a contract between the User and Reactivitude
- It is authorized by legislation to which Reactivitude is subject
- It is based on the explicit consent of the User.
Procedures for the exercise of rights by the user
You can exercise the right of access, rectification or erasure of personal data or restriction of processing of your data and oppose the processing, as well as the right to data portability by contact@reactivitude.com.
Reactivitude will respond in writing (including by electronic means) to the User’s request within a maximum period of one month from receipt of the request, except in particularly complex cases, for which this period may be extended up to two months.
If the requests submitted by the User are manifestly unjustified or excessive, especially due to their repetitive nature, Reactivitude reserves the right to charge administrative costs or refuse to comply with the request.
Breathing of personal data
In the event of a personal data breach, Reactivitude shall, without undue delay and if possible no later than 72 hours after becoming aware of the breach, inform the User of the breach. We don’t have to do that if:
- Whether Reactivitude has implemented appropriate technical and organisational protection measures, and those measures have been applied to personal data affected by the personal data breach, in particular, those that make personal data unintelligible to anyone who is not authorized to access them, such as encryption
- whether Reactivitude has taken subsequent measures ensuring that the high risk to the rights and freedoms of the data subjects referred to in paragraph 1 is no longer likely to materialise; or
- If the communication to the User involves a disproportionate effort on behalf of Reactivitude. In this case, Reactivitude will disclose a public communication or take a similar action by which the User will be informed.
The emails sent by Reactivitude and all its attachments are CONFIDENTIAL and are intended exclusively for the individual or entity indicated therein as recipients.
If you read any email message and you are not the intended recipient, you are hereby notified that any use, distribution, redirection or other form of disclosure to another, printing or copying of the message is expressly prohibited under applicable laws.
If you have received an email message in error, we request that you immediately notify us by email at contact@reactivitude.com and delete it immediately. Reactivitude declines all responsibility for the content of email messages that are changed or falsified.
Updates to the privacy policy
